This is logical to an extent, the extent that the powers to be, who have a challenge with open disclosure, are telling the truth as to the source from which oil comes. When viewing this film, keep in mind the possibility oil may be a byproduct of a biological growth process. One that can be manipulated synthetically. Hmmm, what if?

History tells us that Edward the Confessor, King of England, died in 1066. He was 62 at death. Upon Edward's death a new era was about to begin. William the Conqueror, became King of England by Christmas 1066.

Now, a new version of an old story...

Russia is doing something different beginning this year according to Robert Morley. He quotes Vladimir Putin who states that "the opening of
Russia’s first modern Pacific-based oil export facilities
" is a great gift for Russia.

The 21st century is and will be about pipelines, their flow, and who controls them. This one is about oil, others will involve natural gas, water and any other commodity inclined to flow.

The World is still obsessed with control, rather than with the concept of proportional distribution according to need, rather than want.

We are still a planet of fear, still a ways from balance and proportion.

Today is 12.21.09... The shortest day of the year... the Winter Solstice - Midwinter in the Northern Hemisphere; conversely the Summer Solstice in the Southern Hemisphere.

Historically it denotes a rebirth cosmically, as days become longer rather than shorter.

In history, today has denoted many things, including an ominous link to the Mayan 'long count' calendar. Superstition or fact?

Among other things occurring today in history include the landing of the Pilgrims on Plymouth Rock in Massachusetts. Plus the culmination of the downfall of no less than four Roman emperors that couldn't cut the mustard. Only Vespasian persevered, going forward.

Hey, NewsInternetRadio why is history important?

Because humankind tends to repeat what it fails to learn, like a child who refuses to do their homework.

Advisary commentary is blaming current deficits to the current administration in Washington.

The problem is that the advisary commentary's own administration ran the bills up. These financial problems were there before the election. Today was D-Day 65 years ago; today is 06.06.09...

Today is and was special... It is a day when the conventional probabilities were tested and proven. It terms of manpower, logistics, planning and faith with a healthy dose of trust we overcame the unacceptable, then. Now we are at another same such test. It is the test to see how we will navigate a physics of movement and right action. What do I mean by that? Well, transportation of energy, value, communication and the information we must have to have it all work. Let me give an example. Suppose delivery or transportation was interrupted, that creates either a void or a flood of a needed product, service or commodity? This is what we have on an increasing basis, globally. Denial of its existence will make it worse.

Our elected leaders need to know we the people are who they serve and they are to serve us solutions of "flow". In Latin they would have said "fluvi". We need to "fluvi" with the known laws of what is known and proven; in science, in politics, in business, in health. We need to remind them of their sworn commitment. Yes we all make mistakes and are bigots under the guise of special interest and especially political entities and ideologies. How we love to justify and try to snow each other. Just ego. In ending, suppose there was something in the unseen 90% of visible light and audible sound that was warning us of our collective errors and mistakes and we had a chance to rectify it and correct course? We could be positive and match the negative ground of the Earth to a complete circuit of humanity. What could we achieve? Who well step up and commit to this?

Today is 12.18.08...

 Oh where, oh where are the 'Errors and Omissions'  policies on those entrusted professionals,  licensed, who transact and provide services to  and for the public?

 Who was watching the 'ball'? Harry Truman I've  heard said the 'buck' stopped with him. Are our  values, as a people, diluted and weak? If they  are it is time, now, to recondition our  ourselves.

 We need renewed commitment, discipline and  sacrifice, both individually and as a group. For  this is what a citizen constituency is,  individuals and groups, intermingled together.

 Do our elected servants, Congresspersons, members  of the executive branch and the judiciary carry
 E & O insurance for their breaches and mistakes?

 If not why not? If so, let's get the claims going  for reimbursement.

 They study, supposedly, and become expert in  their specific area. The 'People' who are being  loaded up with public funds liability, or debt  have been less than served or protected by those  corporate entities, governing bodies and 'rules',  in this citizens opinion.

 Where are the public disclosures and  indemnifications?
 
 Will Madoff have all his assets forfeited with a  lengthy prison sentence? He's 70 something, let's  see, if he lives another 15 years can he pay  everyone back? No. He's smiling in all the photos  so far in the New York Times and online that I  have seen.

 Contrast this with a homeless person stealing a  sandwich or some food in a store or market. I bet  a 'gentleman's bet' of one dollar the homeless  person gets jail for over 30 days. I could be  wrong, except that I have been made aware of few  situations on the west side of Los Angeles where  this has occurred.

 Is something in our system broken? Is it  misinterpreted?

Today is 11.02.08...

Barrack has spoken. McCain has changed his position and opinions numerous times to garner votes at the last minute...

In addition, I have promised to go over the L.A. County Election Process of the Voting Procedure as it was in 1996 and point out where it is possible to have problems and descrepencies.

Look at the overall process...

Observer Post 1, Bag Receiving through Observer Post 14, Absent Voter and Unused Official Ballot Card Destruction.

Take a close look at the Los Angeles County Election Process diagram at the last 4 points in the process. In the lower right corner, circled in black and before the release of the ‘Transmit Election results’, notice when this information is released to the media and Internet.

The Ballot Images are transmitted via microwave in ‘packets’ to the ‘Tally Computer’. That is at another physical location and out of view or observation. This was not a challenge in 1996, it was a landslide. It could have been in 2000 and 2004. We will never know.

The question now is, ‘Will this be a problem 2008?’.

Remember Packets NOT chads may be the real issue. Think about it. Even if a few chads are off in the 'count' one way or another, a final adjustment can be made beyond the physical observation of neutral parties, or through the air in transmission itself in the electronic packets. There are 'hackers'.

We, the People, need to require and have a right to a verifiable process including video recording and documentation. This should include a complete  time code for reference at each and every point in this process. This to be conducted with a secure and neutral team for verification.

We deserve no less of our employed, appointed and elected representatives who are entrusted to serve us, the citizens.

Today is 11.01.08...
A few days ago, I linked to an essay I wrote at the beginning of the year. The essay was about 'Torture'.

McCain was the only Senator against it then. He changed his mind and is now for 'Torture' after speaking with Bush, in an interview with Chris Wallace he has a shift from his vote on 'waterboarding'. Can we 'ethically' back and vote for anyone who sees nothing wrong with these value breaches. The motto of West Point Cadets is, "A Cadet will not lie, cheat, steal or tolerate those who do." Hmmm. McCain went to Annapolis and they have a similar version called the Honor Concept.

Barrack spoke tonight and showed all who watched what's happening to various families across America. He addressed each of the following;

1. Social Investments to enhance Citizens    ability in contribute to society.

Energy independence and sufficiency.

3. The [Global] Economy and its health. ( It's all related you know.)

4. Ethics and Values personally, socially and politically.

We await a response from McCain or any other Candidates of other parties in any media.

We respect and support equal time at NewsInternetRadio, though 'Big Media' dose not.It has been essentially 'outlawed', by them, over the years. A well placed media friend even cited a U.S. law to me that supports these media entities to 'control and restrict the opinions and news'... Hmmm.

What does that mean? Do we care, or only when we get laid off and are unable to afford the criminally induced inflation and price of gas at the pump, that funds these entities. Thanks to the likes of 
Ted Stevens and his decades long involvement with accepting the 'payola' of 'Oil-ola', the Major Oil companies. These entities are not 'People', they are only run by 'People'. What does the U.S. Constitution say about this, originally?

Something to think about, until are shaken enough and impelled to act in our own behalf and align our socio-economic system to measure up to the rigorous standards of our Constitution, we will remain in the current 'state of affairs' we are in now.

Democrats, Republicans and Plunderists. What's really true?

Are Liberals liberal? Do conservative conserve anything? Is the current Administration really a new political party, and not Republicans, that truly should be known and defined by their actions as Plunderists? They have plundered the assets of the People. Our Oil, our land, our trust. Are rights are listed first in the U.S. Constitution.

On another topic, perhaps far more important, the transparency of the voting process needs to be looked at.

I, John Ingram Mitchell, was the Official Republican National Committee and Party Poll Observer in 1996.

Clinton won without question. The documents I have linked here are the documents I was given to fill out if anything was wrong. Nothing was wrong in 1996 in Los Angeles County. However, since the 2000 and 2004 elections and the current concerns, I feel it is time to look at how the 2 million plus people in the 8th largest economy in the world are set up to monitor their own voting process.

Here is what I was given to use over a decade ago. I lodged no complaint then. The process is most likely similar to this one and may be cause for concern.

Some may say, "Hey your a Republican, what are you doing?"

Roosevelt, Lincoln were all Republicans and the values they expounded were truly formative in our country's development.
Also, I am an American and I care about having a liberal understanding, with a view to conserve our voting integrity, for everyone, regardless.

My intent is to be truthful, forthright and honest about what is possible in the process I observed then, and may still be in place now.

Over the last few years in my career I have been involved in Process Improvement and Quality Control for a global media company. It is one of the largest DVD and File Based Format content creators serving studios and their customers. I have experience and a focus that may be relevant, all things considered.

I think the 'chads' may have been an attractive destractor and possibly not the true problem in 2000 or 2004.

I suggest we watch the process carefully and
monitor it very closely, to keep our eyes on the
'packets' near the end of the this voting process, when the tabulating occurs. This is when the 'count' is microwave transmitted into the 'air' to another facility, and then the 'final tabulation' is conducted and then returned as the 'final vote'.


Is it really? Let's make sure it is.

You review the documents linked below and tell me, or Rich, if this is a process that could crash and burn.

These are the issues for the United States of America, as our forefathers have indicated.

Any challenges, disagreements or arguments? Let me know please. we need to all drop the political discrimination and work together.

One of our past Presidents, Theodore Roosevelt, said,

"It is better for the Government to help a poor man to make a living for his family than it is to help a rich man make a profit for his company."

For those of you who say, hey there John, he's a Republican! Yes, he was and we probably haven't seen many past President with such appropriate guidance in a time like this. He busted up the Robber Barons and Corporate Trusts "For The People...". It's time again.  Greed creates conflicts in ethics at best.


I will be bold here; Rich and myself have been, from our different subject positions and  perspectives have been attempting to wake everyone up. Are you tired of the 'Sub-Prime' Corporate 'Shell Game'. Do you know which one the 'pea' is under? It's a game of distraction and social subtrafuge for the nefarious purposes of 'Rule by a few' to gaff our economic system. Everything is run by physics, real physics; not the imaginary hypothetically untested brain fart of these academics responsible for doing Wall Streets dirty work.

We, Rich and I, are putting forth, as we have in the past, the true and correct issues facing our country. We spoke today and agreed that they need to be expanded and elaborated upon. Input at our email addresses are totally OK.

These issues need to be focused on and acted upon immediately.

Greed, arrogance and faulty perceptions are the source causes. The European leaders are coming together this weekend in Washington D.C.. Email your Congressperson and Senator.

The needs for the citizens of the U.S., since we control a majority of the markets and affect everyone else:

1. Social Investments to enhance Citizens    ability in contribute to society.       
a.)Financial rewards or service    vouchers for volunteerism and            service to society, global if    possible.

Energy independence and sufficiency.     a.)So other countries can have a    model to emulate responsibly.

   a.) This is huge. This will change    the context of the way we transfer    control of the country to our           children.

What will we hear regarding the real issues, like the four stated on 8.11.08 from our President?

Will we, as a nation of diverse people, be told and promised the issues will improve and the proposed 'Bailout' will upgrade our quality of life? Or will it signal our new mortgage of 21st Century social slavery of all classes, except the elite? I don't know. It is time to think it over.

We are wavering at an important time in our country's history. Our position as individuals and as a people for our future as a nation is riding on what Congress, the President, Corporate Lobbyists for their Corporations and we the people decide and act upon from here on out.

To review the issues when we hear the speech tonight
:

1. Social Investments to enhance Citizens    ability in contribute to society.
2. 
Energy independence and sufficiency.
3. The [Global] Economy and its health.
4. Ethics and Values personally, socially and politically.

When we commit to each, and every, one of these issues as a people, individually, we can achieve lives we have dreamt of.

Actualizing solutions to the Four Issues previously outlined on 8.11.08 will take a mind set and a minimum commitment. Perhaps, a few hours a week on average each. I know you don't have time to work towards saving the country our fore-fathers fought and worked so hard to give and leave to us. OK. Or, we can really create an futures for our kids, and their kids.

I want to say and do more for our common good, however, I don't have a lobbyist in my corner yet. I will commit to serving the People to enable a common good, the one our fore-fathers saw when they framed the Declaration of Independence and the Constitution. We can do this and rebuild our reputation in the world community.

What are the real issues in choosing our president?

Should we, as a nation of diverse people, consider issues that improve and upgrade our quality of life?

We are deciding this at an important time in our country's history. Our standing and future as a people and as a nation is riding on this election.


The issues are:

1.Social Investments to enhance Citizens ability in contribute to society.
2. 
Energy independence and sufficiency.
3. The [Global] Economy and its health.
4. Ethics and Values personally, socially and politically.

If we commit to each, and every, one we could have the lives we all want most likely.

The solution and answer to the Four Issues are:

1. America reducing social program cost through committed volunteerism and contributions. JFK told us something like, "Ask not what your country can do for you, but rather ask what you can do for your country." Sounds like a solid social value to me.

2. By developing our own energy resources, which we "The People" own through our U.S. Governments management of oil leases, the Department of the Interior can retain the asset value for re-investment and distribution use here in our country, for the benefits of the citizens.

3. Through achieving self sufficiency within the U.S., we will set a standard and become a positive model for other countries to aspire to and towards.

4. In demonstrating constructive values and ethics we will transform the disparaging components of our country into a vibrant successful social-economic
cultural entity.

We ca set a new standard, as Tony Robbins has said for a long time. Let's live the ideal and the dream for everyone's benefit.

It starts with us. It starts with me and it will start with you.

What's important in your life? The family? Their future? Your job, a career?

Perhaps you're in school. Preparing for a career or an occupation for the first time. Maybe it's changing an outdated career. Perhaps you want to keep up with current world economy, as it changes.

Can anyone keep up?

Do you trust elected officials?

This is being penned from inside the United States, so we theoretically are, 'free to ask' questions of this magnitude of our government.

That being said...

Attention has been focused on the Appellate Court here in Southern California again. They will be hearing an appeal to rescind Proposition R. The one to limit terms and reduce private interest influence. It actually increased term limits 50% and thus increased the time private interests can creatively contribute and influence these politicos that seem to be avoiding promotion or retirement. In case you forgot, it is the legislation that was whizzed past voters claiming 'TERM LIMITS' a few years back here in Los Angeles. Of course the way it was constructed was to INCREASE TERM LIMITS, thus INCREASING PRIVATE INTEREST INFLUENCE on the Los Angeles City Council.

No problem. California already has the Federal Government 'baby sitting' the Prison and State Hospital systems that are in receivership. Yes, receivership. Is something not working? You make the call.

Why did that happen? Hmmm. We were watching TV, sports or whatever. We dropped the ball, collectively.

Perhaps a few creatively crafted sentences. In a few contracts, in a few pieces of legislation. You know, to get things done, that otherwise no one would agree to willingly.

If it was baseball or some other sport, we would get really worked up and talk about it with our friends and neighbors.

If only we all worked together and upgraded our quality of life, for everyone.

United we stand or divided we fall. It is that simple, whether we like it or not. It is the way it works. We can work it or it can work us.

This is my opinion. I've spoken with people, citizens of the United States that are afraid to speak up. They are afraid of their own government with the Patriot Act and other pieces of legislation. No one seems to know. They aren't really taught in schools anymore. People are taught 'what to think' not 'how to think'. Which do you think is better? What to think sounds like 'brain washing', or for lack of a better word, propaganda; or would 'how to think' be more appropriate in our 'representative republic'?

In regards to a representative republic, as Loren J. Samons II discussed in his book "What's Wrong With Democracy?", there are some serious issues. Dr. Samons is clear in both his book and his lectures at Boston University, and elsewhere, that there are some truly disturbing things about democracy, as practiced in Ancient Greece. He looks clearly to the time of Pericles. His studies and conclusions are worth serious consideration> He points to citizens that are paid to vote. He identifies the requirements that ancient Athenians had to meet to qualify for citizenship. Qualify for citizenship? Yes. There were specific things a prospective citizen had to do. When John F. Kennedy
asked his big question at his inauguration in January of 1960, "Ask not what your country can do for you - ask what you can do for your country.", did anyone really know what he meant or where it most likely came from? No. I bet JFK did. After all he was a trained lawyer and supposedly read an incredible 50,000 words a minute. Yes, I said 50,000 words per minute. I acquired that information from Evelyn Wood Speed Reading. She taught his entire staff how to speed read. Why don't we have speed reading in our public schools? With our tax dollars 40 hours of class isn't too expensive. Even our average students could move further forward. After all, if everyone in elementary school increased their reading speed,
comprehension and thinking skills what would our country look like? Different. Our collective 'quality of life' would be unrecognizable by current standards within a generation.

Whatever happened to the Hemingway approach? Simple, declarative sentences describing the facts, situations and circumstances. Well, the politicians have a lot to loose. Credibility for one. Another is four more additional years of a $180,000 year salary. Not to mention the perks. Their argument is that they need more time to get things done. Hmmm. If that is true, why aren't they getting promoted? Or seeking higher office to do more good? Hmmm.

If and when there are term limits, there would be new relationships for 'private interest' groups to penetrate and influence or be left out of. Just maybe the people will get more of what they voted for with real term limits that put a true cap on a job that really needs to be done successfully in 8 years. If not, retire and call it quits. If an elected official is really doing a bang up job, promote them to the next higher office or highest office where good can be done for people, the constituency.

Independence, Freedom and Liberty. Great concepts with great intent and meaning.

These three words with their powerful symbolic meanings leads us, the Citizens of the United States, down an appearing pre-determined route  our elected leaders, who are influenced and courted with economic promise of re-election and other enticements by non-Citizens such as Private Interests, those of a commercial and business embodiment.

Remember and perhaps read again our Constitution. It states only rights to 'People' or 'Persons' here in the United States. Unfortunately this would mean an entity with a lifespan and susceptible to illness, disease and death in regards to the human organism. No business entity has been known to contract Cholera and either recover or die. These entities are conceptual, after the fact. They cannot have precedent or priority of the People or Persons who the Constitution says has Rights and gives none to others.

The Constitution came first, not the interpretation by 'influenced' elected representatives, acting by sworn Oath to serve People and Persons, the Contracts Clause that made business more prominent from the 1830's forward. Precedents are first, supposedly. The U.S. Constitution is the precedent and thus first before other legal layerings. Seems plain enough for even those of limited education to grasp.

Here, as a reminder, from our Constitution in
Article I, section 10, Clause 1. It clearly states:

"No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility."

It does not deal with the limit of time, nor does it deal with the repayment of debt by Federal Reserve Notes that are not Gold nor Silver, which our currency has become. It appears there's been so much overlooked, yet when it comes time to limit lawsuits by Citizens, the People, our Judiciary does not hesitate to set aside Citizens in favor of Corporations and Businesses. It is said, by various Judges, as printed in the Mainstream Media, both State and Federal including Supreme Court Justices, that there is nothing in the Law at this time to remedy this situation. Really?

Seems that the First set of Laws, the Constitution, its Articles and its Amendments are being disregarded and overlooked, with no one in a legal capacity acting as our true advocate, acting in out behalf.

From Senator Ron Wyden's website regarding our oil revenues regarding the uncollected lease monies comes the following comment which seems apropos at this time.

“In Washington we hear all the time from lobbyists and corporations about what we can and can’t do about our reliance on foreign oil,” Wyden said. “The Fourth of July is coming up and there is nothing more patriotic than finding ways to make the U.S. independent when it comes to energy.” 

He is one of the few elected servants who appears to be serving, per his oath as a Senator, to uphold the United States Constitution, for ‘The People’.

Timely Talk and Thought... on 6.14.08, a Saturday, our Flag Day.

As planned, an essay for Flag Day. Some things are worth considering, some things can change our life in an instant. The subject is a local one. Proposition R seemed easy and straight forward. If it had been a single item issue posed before us it wouldn't have come to this lawsuit before the 2nd Appellate Court here in California.

This is the first of several essays; over the next few weeks approaching the Courts decision. Of course, it may be bumped up to the California State Supreme Court. Why, you ask? Because the 2nd Appellate may not want to defy the City of Los Angeles. There may be relationships at risk. I do not know. I do know it involves politics. Politics seem to imply a social connective bias. I'll leave that for another essay, one of an experiment; politics as bias and discrimination.

First, Proposition R implied that City Council members would have their terms limited. That isn't what happened. Consider that before Prop R the limit was two terms of four years each and after Prop R there are now three terms of four years. Hmmm... Doesn't that appear a little deceptive? I think so. If they, the authors of Prop R, intended clarity, it would have been worded differently, pure and simple. David Hernandez and Ted Hayes saw this one and decided to bring it to our attention. Thank you David and Ted.

Second, by increasing the time a City Council member can serve is a 'term expansion' not a 'term limit'. Is this really that hard to understand? I don't think so. And you, how does it appear to you? Consider, if it were truly a 'term limit', then it would have been crafted by the authors as a 'term reduction', pure and simple. They didn't. For it to be a single clear English sentence that an eighth grader can understand would have met the standard that TV, the Movies and the print media use as a guideline. That is common knowledge.

Seems clear enough, right? I know, they were confused and meant something else. Right. If that's the case, then repel it and dismiss the authors for not doing their job. They let the citizens of Los Angeles down in a huge way. Now our Judges have to waste their time and out tax money cleaning up something that should never have been allowed to come about in the first place. They really have more serious matters on their dockets.

This is a delicate and tricky legal and political issue. It is nothing less than a legal and legislative Gordian Knot. Alexander the Great, you may recall, took his sward and cut the knot to solve the challenge and got on with the business at hand, conquering the rest of the world. Our Judges need to move on to other more important cases. Certainly poor use of words or worse the deceptive use of words is a most alarming situation when carried out by our trusted public servants. We deserve much better and much more.

To conclude this essay segment, the twisting and misrepresentation that is obvious upon careful reading really is deceptive and lacking ethics at any level. I was in conversation with a few people over the last few weeks, some quite well educated, and they seemed to think nothing of this oversight. I asked them if they were aware that the President of the United States was limited to two terms of four years. They said they were and that was different. I asked how did it differ and their response became abrupt and reeking of anger. Hmmm. Why, I wondered.

The next Essay being prepared is to include a comparison of the California State Constitution, the U.S. Constitution, a passage from the Articles of Confederation and of course one from the Federalist Papers. It is amazing how well they all compliment and support each other. Wouldn't it be great if we, as citizens and people, could do the same. T.B.C.

Here's a hint. The selection of one sentence from each source, in the upcoming essay, should be able to focus in on the core of the Prop R issue.

An attempt will be made to extract a kernel of wheat, a sentence, from the chaff of the abundant concepts, to see the arguments. Hopefully, within a foundational constitutional set of premises. Can this be possible for a layman to do? The willingness is here to see if it is. You're invited to follow along where this literary experiment, a test, or trial goes. 

It seems to make sense as there is, after all, a legal trial at hand, and the term 'essay' in French is 'essai', which means essentially to test, try out or conduct an experiment. T.B.C.

Politics, Courts, Legislatures and the  Executives are all to serve the People who elect them, or appoint them through their representatives. This is according to the original Constitution of the United States, and for that matter any State Constitution in the Union that was formed after the Revolutionary War. 

The way of change is through the term 'interpretation', so it seems. Sounds almost like the way religions continually are getting into trouble over the course of time. 

Is anything literal? Literature, perhaps? Hmmm. Not always. The Law, or the various religious scriptures? Some say yes, others say no. Some even say it depends. But on what, can be asked? We are all so educated, and smart, compared to the 3% literacy rate of 2,000 years ago. So why are we still finding ourselves as messed up as a planetary people? Are we on the brink of disaster and ruin? We seem so unwilling to respect the obvious laws of the Universe. We cannot see through our perceptions that were formulated and slanted from our 'subject positions', where we grew up, what socio-economic and race experiences we had or learned, for example. 'Subject Position' is a 'feminist' term and I'm a 'masculinist', it follows logically. I love the term. It is so encompassing and expressive. Regardless of gender, culture, ethnicity or psycho-socio-economic reality, it works to really 'get' what is, for ourselves and others. Let's all consider and 'Google' the term 'subject position'. Go ahead, it's OK to find out what it means if you don't already. This is a conceptual tool that we all can use to understand each other with. Let's give it a try, OK?

Let's keep in mind that one persons' interpretation will vary or differ depending on who has the most influence. Influence can be 'dirt' on someone (sometimes known as extortion or politics), or perhaps physical assets. Property, cash, commodities, or whatever is deemed of value at a given moment in time.

Interpretation then is our real government and ruler. Another way to say this is whoever can dominate and promote the strongest point of view is in control. Not ultimately. Physics has the 'veto' vote and always wins, regardless of the words spoken or by whom. Ask yourself, 'How many coincidences does it take in nature to make a natural law apparent and obvious?'. 

The answer is...

Oh come on, that's getting... unfair? 

No, it's not. It is a fact, whether we like it or not. If you disagree, then please go to the ocean, any ocean, and stop a wave. Get it on film and then I will concede, and write a formal apology. If you cannot stop a wave or even an earthquake or any other weather expression, then please come to your senses and get on board and become part of the solution. It may be uncomfortable. Einstein I recall said something to the effect that change was humankind's biggest problem and challenge. Acceptance, planning and teamwork will start solving our challenges, regardless of politics and religion. Denial and selfishness are what's acting out at present, it seems from our results as of late.

Consider this case in point. The reality in China is that they have been so hell-bent on growth and dominance to be bigger and better than everyone else that they took a few short cuts, to demonstrate superior mental willpower and prowess.

Building codes and engineering that respected geographical realities were unimportant. Deadlines and established goals were more important. They have come a long way very quickly. Now they will need to waste a lot of time and materials going back and cleaning up before they can move forward. What would Confucius, Lao Tse or Chairman Mao say? Think of the energy that will be consumed. All because long term thinking and planning ignored the inevitable and obvious limits. Particulated critical and analytic thinking needs to be considered and not dismissed as academic rhetoric. 

Let's all quietly think for a moment. How much time will it take to go backwards to correct these over sites? And how much time will it take before they can catch up to where they could have been had a little different approach been taken? Suppose they had respected science reality as much as for progress and superiority over others. At what cost? The proven laws of physics as expressed in the more advanced building codes and civil engineering of other countries may have actually proven the faster way. Consider Aesop's fable, 'The Tortoise and the Hare'. Looks to me as though it is still true. Enough about them, they may listen to the Universe and they may not. Most humans don't until its either too late or almost too late. 

Now what about us, here in the U.S., in Los Angeles? 

Since the last post, there's been some positioning and counter positioning taking place. We have a world that is speeding up. Any, and I do mean any,  errors are now magnified immediately and in a large way. Sub-Prime Mortgages for example. Any disagreements there? Didn't think so. 

In regards to Prop R, the Briefs for all parties have been completed and filed with the California Appellate Court, 2nd District, Division 8, Clerk this afternoon. There is some reading and contemplation coming. The Judges, there are three, and their clerks, will be busy reading, citing, outlining then preparing the best understanding and opinion possible to facilitate each Judge. Who are these Judges?

As promised days ago, here are the links to the three Judges that have the arduous and challenging task to undertake. To uphold the Constitution of California, or make an exception and allow the People of this State to be 'bamboozled' by deceptive advertising and promotion tactics. If it were a car 'ad' by a Car Dealer, it could be considered 'false advertising' or even 'bait and switch'. Will it be seen for what it is so clearly? We'll see. Hopefully the physics of the words will seen for what they are.

Let's give respect to these Judges for this unpleasant job of deciding something that appears so obvious. It is only obvious is one considers the Politicians promoting Prop R used the words 'Term Limits' not 'Term Reductions'. Personally, I have a feeling that most voters trusted their elected representatives and hired civil servants to honestly tell the truth and respect the single issue requirement that the State Constitution requires.

I'll have more of a review and comment next week after reading and thinking over all these fillings. Of course, they will be from a citizen's point of view and subject position, not a member of the Bar. Maybe I'll even be befuddled for a few days. Forgive me if I am. Thank God, oops, sorry atheists, thank goodness the Judges and their clerks have 90 days to sift, consider, research and then render a verdict. Some of the wordage is pretty thick. It's legalize, another dialect of American English. Whatever happened to the simple English rules of Insurance Law? Oh yeah, there is no insurance here, yet. At least not until the Constitution is protected by our elected and appointed servants.

Where are the Federalist #10 ethics and James Madison? Where,oh where, is Publius, when we need him or her most? TBC, to be continued.

The Prop R Lawsuit challenging the City of Los Angeles is now 90 days from a Judiciary ruling locally. It could end up before the California Supreme Court eventually, if reason, logic and law are too hard to accept and acknowledge. 

The Appellant's case is for the citizens and people of Los Angeles to reset the  pre-existing lower term limits on their local elected representatives. The City of Los Angeles case is for increasing the term limits, contrary to presenting Prop R as a term limiting proposition. It was inferred as a reduction of terms in office. The specificity of clear language to the voters was not used and can be questioned as to the intent, possibly. Without simple direct language confusion is certain as always. 

When will straight forward language be the law of the land?

Below is the unabridged briefs of both sides. The arguments are simple. Yet as with most legal language, the wording is a bit thick. Take a look at the work elected officials create with taxpayers money. Your taxes essentially are used to just stay in office a little longer. Aren't there other logical roles and functions they can offer for hire in the public and private sectors?

The Appellant's Reply Brief is the last item now before the decision and is the final comment before the Judicial Tribunal's deliberation and determination in 90 days. Tomorrow we will publish the website links to the 3 Judges that will restore the pre-existing term limits or disenfranchise the voters and expand term limits and support the City of Los Angeles in their quest to go against the flow of the national movement for term limits and greater transparency in the voting process.

It has without question monumental impact on the citizens of Los Angeles, California and the nation. Why? Simple, the rule of law as it pertains to the fundamental and foundational basis of state constitutions and the Constitution as a whole in the United States. If a constitution, state or Federal, can be usurped or abridged by legislative or judicial whim or fancy, we are in some trouble as a nation, culture and the social system of democracy, regardless of political party affiliation.

On a side note, yours truly, the Editor, was one of 2 Official Poll Observers in the 1996 Presidential election here in Southern California. The process that was in place then and its local and national ramifications are the subject of an upcoming Timely Talk and Thought expose that should add clarity after some surprising revelations are opened for public view. The process is quite interesting and is a lot more than chads.

We await insight into the Prop R Lawsuit against the City of Los Angeles. Perhaps it will be pointed out that the City has overlooked a few things in haste, such as the California State Constitution. Maybe the brief will show the disregard making Prop R invalid. Why wasn't Prop R properly named as 'Term Expansions', which is what it does, expands, not limits as it was promoted to the trusting public.  The suit brings this important test of the rule of law and whether and Constitutions are really protecting the people whom the California State Constitution is to do. 

More fundamental than the sloppy manner in which Prop R's Constitutionality was either overlooked, oops, or not considered, is the waste of State taxes in trying to defend what appears to be a clear, and silly rouse. 

Worse still is it may be possible that it was intentionally crafted to get past a busy, overworked and gas distracted public. Let's hope not. We all deserve much more from our elected servants. After all we are their employers. Hmmm, something to think about tonight while we wait to see and read for ourselves the official answer to the City's response. The judges will surely be put to task. Making a Constitutional decision doesn't come along everyday quite like this. Let wait and see. It will be important to read and reflect.

On another note, let's focus on something of a far more positive in terms of the brotherhood and chance for bringing cultures and people together. Harmony is good for everyone. An insight into the suit to invalidate Prop R and retain 2 term limits as opposed to the expansion that Prop R mislead, twisted, concealed and omitted from the voters. Here is a direct quote from the attorney working to restore the lower term limits that existed prior to the deceptive Prop R.

"No good lawyer ever "guarantees" the outcome of litigation.  Nevertheless, my clients and I are reasonably confident that our appeal will succeed in invalidating Prop. R even if the measure is found to violate the single-subject rule, the California Supreme Court thoroughly addressed -- and squarely rejected -- that argument in the Open Primary case just two years ago." 

There you have it...

Sounds silly, but think about it, before Prop R there were 2 terms and after Prop R there were 3 terms. Simple math tells the story, 2 is less than 3. Prop R expanded not reduced the limits and was cloaked within a multiple issue initiative for the voters to be confused and mislead with. You decide. Next week we will publish the Judges that will rule up or down in this matter. You need to be aware of who is protecting you or disenfranchising your voice and vote as guaranteed under the Constitutions of our State of California and Federal Government.

Last week it was quiet while we wait for a final response from the Plaintiffs in the Prop R Litigation suit against the L.A. City Council. It will be interesting to see what the 3 Judges, whom we we cite after all the responses at submitted to see which ones vote to get back to 2 terms from the expanded 3 terms that Prop R appeared to conceal in there public campaign.


Here's a thought that we all should consider since the 'Homeless Population' is still an issue in America and in our City  of the Angels from a David Hernandez email.

“Hospital Dumping” Is it a homeless or medical issue? With the City Council passing the anti dumping ordnance we won’t find out. They just passed a law and washed their hands of it.

 

If a homeless person receives medical treatment at a local hospital and refuses to leave, the hospital must keep him. Now the hospital becomes a defacto homeless shelter. How many beds in a hospital need to be filled with homeless before the hospital turns away patients or closes.

 

With one billion spent on homeless in Los Angeles , why is there no center for the hospital to take them? That’s the real crime! "

Last week there was an important follow-up to the Press Conference regarding the upcoming Court Ruling on the challenge and the Appeal's disposition in June or July according to a lawyer involved in the case. 

A significant issue that is being overlooked is the partial implementation of a valid and standing Special Order, number 40 to be exact. 

The question is, as others such as David Hernandez and Ted Hayes, when is it OK to selectively enforce and overlook certain portions of a Special Order and when isn't it. You decide.

By the way this is an issue that affects everyone living near an International Border, at least all people who live and work in Los Angeles, California.

Last week there was an important Press Conference that affected all people who live and work in Los Angeles, California. 

The way politicians have changed a law with the unknowing support of voters to violate the California State Constitution is of foundational concern according to an attorney involved in this case. The ultimate legality of Proposition R will be heard in June or July of this year. This may be setting precedents to completely disregard the 'Rule of Law. by the Judiciary here in California and perhaps the Nation. This will occur all with the approval of an uninformed voter base. Is this a new development? No, the strategy and tactics are simple and as old as time and politics.

Before Prop R:
2 term limits
of four years each.

After Prop R:
3 term limits
of four years each.

Hmmm.

And you, the voter, were told it was going to limit terms. It did, they authors of Prop R didn't tell you it already limited to 2 terms and would expand it to 3 terms. That is omission, twisting, misrepresentation and concealment possibly it appears. Smells like voters have been defrauded and disenfranchised with deceptive materials of Prop R's promotive using the U.S. Postal Service to carry out this scheme.

Then again, who cares when gasoline is around $4.00 a gallon. Or perhaps someone in your family has either lost their job or been killed in a war, far from home. Our minds have so much to do everyday... in our lives.
